1. Privacy Policy Overview

This Privacy Policy describes how LipeWell LLC ("LipeWell," "we," "us," or "our") collects, uses, and discloses information about you when you visit lipewell.com, use our application, complete our symptom assessment quiz, or otherwise interact with our services (collectively, the "Services").

By using our Services, you agree to the collection and use of information in accordance with this policy. If you do not agree, please do not use our Services.

Your privacy matters. We do not sell your personal information. We do not use health-related information you share with us for advertising targeting purposes. We store all sensitive information using industry-standard encryption.

2. Information We Collect

2.1 Information You Provide Directly

  • Account registration: name, email address, password (hashed)
  • Quiz and assessment responses: symptom descriptions, health history questions, and self-reported health information
  • Payment information: billing name and address. Credit card numbers are processed by our payment processor and are not stored on our servers
  • Community posts: content you voluntarily share in the LipeCircle™ community
  • Support communications: messages you send to our support team

2.2 Information Collected Automatically

  • Device information: IP address, browser type, operating system
  • Usage data: pages visited, time spent, clicks, quiz funnel progression, session duration
  • Cookie and tracking data: see Section 5

2.3 Health-Related Information

Our Services involve self-reported health and symptom information (pain levels, swelling patterns, lifestyle factors). This information is used solely to personalize your LipeWell experience and is not sold or shared with third parties for advertising purposes.

3. How We Use Your Information

We use the information we collect to:

  • Provide, operate, and improve our Services
  • Personalize your NutriProtocol™, LymphMove™, and SymptomAI™ experience
  • Process payments and send transactional emails
  • Send marketing emails where you have opted in
  • Analyze aggregate usage patterns (using anonymized data) to improve our platform
  • Comply with legal obligations and protect against fraud

We do not use your health information to target you with advertising, build advertising profiles, or sell to data brokers.

4. Sharing & Disclosure

We do not sell your personal information. We may share your information with:

4.1 Service Providers

Vendors that help us operate our Services under strict data processing agreements, including payment processors, email providers, analytics providers, and hosting services. These providers may only use your information as directed by us.

4.2 Analytics & Advertising Partners

We use Meta (Facebook) Pixel to measure the effectiveness of our advertising. We share hashed email addresses and general behavioral data with Meta for this purpose. We do not share self-reported health symptom responses with Meta. You may opt out at facebook.com/privacy/policy.

4.3 Legal Requirements

We may disclose information when required by law, court order, or to protect the rights and safety of LipeWell, our users, or the public.

4.4 Business Transfers

If LipeWell is acquired or merges with another company, your information may be transferred. We will notify you before your information is subject to a different privacy policy.

5. Cookies & Tracking Technologies

  • Essential cookies: Required for session management and security
  • Analytics cookies: Anonymized session identifiers to understand site usage
  • Marketing pixels: Meta Pixel for ad performance measurement and retargeting

You may disable cookies through your browser settings. Disabling certain cookies may affect functionality. California residents, see Section 7.

6. HIPAA Notice of Privacy Practices

Note: LipeWell is a consumer wellness application and does not qualify as a "covered entity" under HIPAA for most of its functions. However, we voluntarily adopt HIPAA-inspired privacy standards for all health-related information you share with us.

What health information we collect

When you complete our symptom assessment or log daily symptoms, you provide self-reported health information including symptom severity, pain levels, mobility, and related details ("Health Information").

How we use your Health Information

  • To generate your personalized LipeWell protocol
  • To track your progress within the app
  • In aggregate, anonymized form only, to improve our algorithms and content

How we do NOT use your Health Information

  • We do not share identifiable Health Information with advertisers
  • We do not sell Health Information to any third party
  • We do not share Health Information with employers, insurers, or healthcare providers without your explicit consent

You may request access to, correction of, or deletion of your Health Information at any time by emailing privacy@lipewell.com.

7. California Privacy Rights (CCPA/CPRA)

California residents have specific rights under the California Consumer Privacy Act (CCPA) as amended by the CPRA:

  • Right to Know: Request categories and specific pieces of personal information collected about you in the past 12 months
  • Right to Delete: Request deletion of your personal information, subject to certain exceptions
  • Right to Correct: Request correction of inaccurate personal information
  • Right to Opt-Out of Sale/Sharing: We do not sell personal information. We do share limited data with Meta for advertising measurement. Opt out by emailing us or using the Global Privacy Control signal in your browser
  • Right to Limit Use of Sensitive Personal Information: Request limitation of our use of sensitive personal information to what is necessary to provide our Services
  • Right to Non-Discrimination: We will not discriminate against you for exercising any of these rights

Submit requests to: privacy@lipewell.com with subject "CCPA Request." We will respond within 45 days. We may need to verify your identity before processing your request.

8. Data Security

We implement industry-standard measures to protect your information:

  • TLS/HTTPS encryption for all data in transit
  • Encrypted storage for sensitive information at rest
  • Hashed passwords (bcrypt)
  • Access controls and regular security reviews

No method of transmission over the internet is 100% secure. If you become aware of any security vulnerability, please contact us at privacy@lipewell.com.

9. Data Retention

We retain your personal information for as long as your account is active. After deletion, we may retain anonymized or aggregated data for product improvement. Transaction records are retained for up to 7 years for legal and tax compliance.

10. Terms of Use

10.1 Acceptance

By accessing or using the LipeWell Services, you agree to be bound by these Terms. If you do not agree, do not use our Services.

10.2 Eligibility

You must be at least 18 years of age to use LipeWell Services.

10.3 Account Responsibility

You are responsible for maintaining the confidentiality of your account credentials. Notify us immediately of any unauthorized use at privacy@lipewell.com.

10.4 Subscription and Billing

  • Monthly Plan ($19/month): billed monthly, cancel anytime before next billing cycle
  • Annual Plan ($99/year): billed annually, cancel before renewal to avoid next charge
  • Lifetime Plan ($149 one-time): no recurring charges

Contact privacy@lipewell.com within 30 days of purchase if you are not satisfied to request a refund review.

10.5 Acceptable Use

You agree not to: (a) use the Services for any unlawful purpose; (b) share or sublicense your account; (c) scrape or redistribute our content without permission; (d) post abusive or harassing content in LipeCircle™; (e) attempt to reverse engineer our platform.

10.6 Intellectual Property

LipeWell™, NutriProtocol™, LymphMove™, SymptomAI™, and LipeCircle™ are trademarks of LipeWell LLC. All content, designs, and software within the Services are protected by copyright and intellectual property laws.

10.7 Limitation of Liability

To the fullest extent permitted by law, LipeWell LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Services. Our total liability for any claims shall not exceed the amount you paid us in the 12 months preceding the claim.

10.8 Governing Law

These Terms are governed by the laws of the State of Texas. Any disputes shall be resolved in the state or federal courts located in Travis County, Texas.

10.9 Changes to Terms

We may update these Terms at any time with notice via email or in-app notification. Continued use after notice constitutes acceptance.

11. Medical & Health Disclaimer

LipeWell is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease or health condition.

The content provided through LipeWell — including NutriProtocol™, LymphMove™, SymptomAI™, and LipeCircle™ — is for general wellness and informational purposes only.

Always consult a qualified healthcare provider before making changes to your diet, exercise routine, or health management plan, especially if you have been diagnosed with or suspect you have lipedema or any other medical condition.

The symptom assessment quiz is a self-screening tool intended to raise awareness — not a clinical diagnostic instrument. A result from our assessment does not constitute a medical diagnosis.

Testimonials reflect individual experiences and are not guarantees of specific outcomes. Individual results will vary.

Advisory board members contribute to content development and review. They do not provide direct patient care through LipeWell and are not in a patient-provider relationship with LipeWell users.

12. FTC Disclosure

In accordance with FTC guidelines (16 C.F.R. Part 255):

  • Paid testimonials: Some testimonials may have been provided by members who received complimentary or discounted access in exchange for honest feedback. All testimonials are genuine and reflect real member experiences.
  • Affiliate relationships: LipeWell may use affiliate marketing arrangements through third-party platforms including ClickBank, Buygoods, and similar networks. LipeWell and/or its marketing partners may receive compensation when you purchase through these platforms.
  • Advertising: LipeWell runs paid advertising on Meta and Google. Our advertisements are identified as such by those platforms in compliance with their policies.

These commercial relationships do not affect the quality, accuracy, or integrity of our educational content.
